End User License Agreement (EULA)

1. Acceptance of Terms
By accessing or using the donbmedia.com website (the "Site") and any video content, services, or materials provided therein (collectively, the "Content"), you agree to be bound by these End User License Agreement (EULA) terms (the "Agreement"). If you do not agree to these terms, please do not use the Site or access the Content.
2. License Grant
Subject to your compliance with this Agreement, DBennett Media LLC grants you a non-exclusive, non-transferable, revocable license to view, access, and use the Content solely for your personal, non-commercial use.
3. Purchase and Use of Content
a. Purchase Rights: Content available for purchase through the Site may be used in accordance with the specific licensing terms associated with that Content. Upon purchasing Content, you are granted a license based on the licensing terms provided at the time of purchase.
b. Non-Commercial Use: Content not purchased or otherwise explicitly provided as free of charge is for non-commercial, personal use only. Any commercial use requires separate licensing and authorization from DBennett Media LLC.
c. No Redistribution: You may not reproduce, distribute, transmit, publicly display, or create derivative works from any Content unless explicitly permitted by DBennett Media LLC in writing.
4. Restrictions
You may not:
a. Modify: Alter, transform, or create derivative works based on the Content.
b. Sell or Transfer: Resell, sublicense, or transfer the Content to any third party without explicit permission.
c. Circumvent Protection: Attempt to bypass any digital rights management (DRM) or other technological protection measures.
5. Ownership
All Content and intellectual property rights, including copyrights, trademarks, and trade secrets, are owned by DBennett Media LLC or its licensors. This Agreement does not grant you any ownership rights in the Content.
6. Unauthorized Use
In the event of unauthorized use of Content:
a. Infringement: Unauthorized use of Content, including but not limited to copying, redistributing, or using Content for commercial purposes without proper authorization, constitutes copyright infringement.
b. Legal Recourse: DBennett Media LLC reserves the right to pursue all legal remedies available to address unauthorized use, including seeking damages and injunctive relief.
7. Termination
DBennett Media LLC reserves the right to terminate your access to the Site and/or Content at any time, with or without cause, if you violate any term of this Agreement. Upon termination, you must cease all use of the Content and destroy any copies in your possession.
8. Disclaimers and Limitation of Liability
a. Content Accuracy: While DBennett Media LLC strives for accuracy, the Content is provided "as is" without warranties of any kind. DBennett Media LLC disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
b. Limitation of Liability: DBennett Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Site or Content.
9. Indemnification
You agree to indemnify, defend, and hold harmless DBennett Media LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or Content, or any violation of this Agreement.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Tuscola County, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be resolved in the courts of Tuscola County.
11. Modifications
DBennett Media LLC reserves the right to modify this Agreement at any time. Your continued use of the Site and Content following any such modification constitutes your acceptance of the revised Agreement.
